1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Kisu AI website, AI image generation, AI video generation, and related services (collectively, the "Service") provided by Kisu AI ("Kisu AI", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Service Description
Kisu AI provides tools that use artificial intelligence to generate content, including but not limited to images, videos, and text, based on prompts and inputs you provide. You understand that:
- AI-generated outputs may be inaccurate, incomplete, or unexpected.
- AI-generated content may not always be unique.
- You are responsible for reviewing and using outputs appropriately and lawfully.
We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
3. Eligibility
You may use the Service only if you:
- Are at least the minimum age required in your jurisdiction (and at least 13 years old), and
- Have the legal capacity to enter into a binding contract.
If you use the Service on behalf of a company or other entity, you represent that you are authorized to accept these Terms on its behalf.
4. User Accounts
To access certain features of the Service, you may need to create an account. You agree to:
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.
You must promptly notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.
5. Subscriptions, Credits, and Payments
Some features of the Service may require payment of fees, such as subscriptions or usage-based credits. By purchasing a paid plan or credits, you agree to:
- Pay all applicable fees displayed at the time of purchase.
- Authorize us and our third-party payment processors to charge your payment method.
- Provide accurate billing information and update it as needed.
Unless otherwise stated, fees are non-refundable except where required by law. We may change pricing or introduce new charges from time to time; any changes will apply going forward and will be communicated to you where required.
6. AI-Generated Content and Ownership
6.1 Your Inputs
You retain any rights you have in the content, prompts, and materials you upload or submit to the Service ("Inputs"). You grant Kisu AI a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your Inputs:
- To operate, provide, and maintain the Service
- To generate AI outputs at your request
- To prevent abuse and ensure the security of the Service
6.2 AI Outputs
Subject to these Terms and applicable law, as between you and Kisu AI, you may use the AI-generated outputs ("Outputs") you receive from the Service for any lawful purpose, including commercial use, unless otherwise specified in your plan or in the Service.
You are solely responsible for how you use the Outputs and for ensuring that your use does not violate any applicable law or the rights of any third party.
6.3 Use of Inputs and Outputs to Improve the Service
We may use Inputs, Outputs, and related usage data to operate, maintain, and improve the Service, including improving models and developing new features, subject to this Agreement and our Privacy Policy.
You should not share any confidential, sensitive, or personal information in your Inputs that you do not want processed by our systems.
7. Acceptable Use and Prohibited Content
You agree not to use the Service to create, upload, or share any content that:
- Is illegal, harmful, fraudulent, or deceptive
- Infringes any copyright, trademark, privacy, or other rights of any person or entity
- Promotes hate, harassment, discrimination, or violence
- Contains sexually explicit material involving minors or exploits or harms children
- Promotes self-harm, suicide, or serious physical injury
- Includes non-consensual intimate imagery or deepfakes intended to deceive or harm
- Violates any applicable law or regulation
You also agree not to:
- Attempt to reverse engineer, decompile, or otherwise extract source code or models from the Service
- Interfere with or disrupt the operation of the Service or its infrastructure
- Circumvent any access or usage limits (for example, rate limits or credit limits)
- Use the Service for high-risk purposes where failure of the Service could lead to death, personal injury, or severe environmental or property damage (for example, medical diagnosis, critical infrastructure, or life-support systems)
We reserve the right (but have no obligation) to review content and to disable or terminate accounts that violate these rules.
8. Intellectual Property
The Service, including all software, models, features, and content provided by Kisu AI (excluding your Inputs and Outputs), is owned by Kisu AI or its licensors and is protected by intellectual property laws. Except as expressly allowed in these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service.
9. Third-Party Services
The Service may integrate or interoperate with third-party services (such as payment processors, storage providers, or model providers). Your use of any third-party service is subject to that provider's terms and privacy policies. We are not responsible for third-party services and do not endorse or assume any liability for them.
10. Termination
You may not use our service:
We may suspend or terminate your access to the Service at any time, with or without notice, if:
- You violate these Terms or any applicable law
- We are required to do so by law
- We elect to discontinue the Service
You may stop using the Service and close your account at any time. Upon termination, your right to access and use the Service will immediately cease. Certain provisions of these Terms (including ownership, disclaimers, and limitations of liability) will survive termination.
11. Disclaimers
The Service and all content, Outputs, and features are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Kisu AI disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- The Outputs will be accurate, reliable, or suitable for any particular use
- Defects or errors will be corrected
You are solely responsible for evaluating the accuracy and appropriateness of any Outputs before using them.
12. Limitation of Liability
To the maximum extent permitted by law, Kisu AI and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these Terms or the Service will be limited to the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or, if you have not paid, one hundred US dollars (USD $100).
Some jurisdictions do not allow limitations of liability, so some of the above limitations may not apply to you.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. If changes are material, we may provide additional notice (for example, by email or by posting a notice in the Service).
Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
